Welcome to Nexca (“we,” “our,” or “us”). By accessing our website and using our services, you (“customer,” “buyer,” or “you”) agree to the following Terms & Conditions. Please read them carefully before placing any orders.

1. Scope of Services

  • Nexca provides access to Japanese auto auctions and facilitates the purchase, inspection, export, and shipping of vehicles to your designated port.

  • We act as an auction agent and exporter, not as the manufacturer of the vehicles.

2. Registration & Deposit

  • To participate in bidding, a refundable security deposit of JPY 100,000 is required.

  • Payment can be made via credit card, PayPal, bank transfer, or escrow through our website.

  • Deposits are deducted from the final payment if bidding is successful. If not, they remain valid for future bids or can be refunded upon request.

3. Bidding & Purchase

  • Customers must confirm their maximum bidding price in advance.

  • Nexca will bid on behalf of the customer within the confirmed limit.

  • Once a vehicle is successfully won, the purchase is legally binding and non-cancellable.

  • If a bid is unsuccessful, Nexca will continue bidding on alternative vehicles with your confirmation.

4. Auction Agent Fee

  • Nexca charges an 8% auction agent fee based on the vehicle’s winning bid price.

  • This fee is included in the final invoice.

5. Payment Terms

  • A proforma invoice will be issued after a successful bid.

  • The final payment (winning bid + fees – deposit) must be made within 7 working days.

  • Accepted payment methods: bank transfer, PayPal, credit card, or escrow (where available).

  • Late or incomplete payments may result in cancellation, with forfeiture of deposit.

6. Shipping & Documentation

  • Nexca arranges shipping, inspections, and insurance (if requested).

  • Vehicles are shipped to the port specified by the customer.

  • Original shipping documents (Bill of Lading, Export Certificate, etc.) will be sent by post after final payment is confirmed.

  • Final payment is only released to us once documents are dispatched.

7. Condition of Vehicles

  • All vehicles are purchased “as is” from auctions.

  • Nexca provides photos, inspection reports, and auction sheet translations to assist your evaluation.

  • Nexca is not responsible for hidden defects, mileage discrepancies, or mechanical issues undisclosed by the auction.

8. Refunds & Cancellations

  • Deposits are refundable if the customer no longer wishes to continue bidding, minus any bank/transaction charges.

  • Successful bids are binding; no cancellation or refund will be issued once a vehicle is won.

9. Liability Disclaimer

  • Nexca is not liable for delays caused by shipping companies, customs clearance, natural disasters, or regulatory authorities.

  • Import duties, taxes, and compliance requirements in your country are the sole responsibility of the buyer.

10. Governing Law

  • These Terms & Conditions are governed by the laws of Japan.

  • Any disputes will be subject to the jurisdiction of Japanese courts.
